Terms of Service

These terms are an agreement between you and Pursut ("Pursut", "we", "us") covering our website, client portal and services. By creating an account or buying a plan, you agree to them. If you use Pursut for a company, you confirm you're authorized to agree on its behalf, and "you" includes that company.

Pursut is a service business. We offer Blueprint, Partnered Launch and Growth, as described on our pricing page and plan pages. We use our own software and third party tools to deliver the work, but you are buying a service, not a software license.

The specific scope, timeline and deliverables for your engagement are confirmed when you sign up or in a written engagement confirmation. If that confirmation conflicts with these terms, the confirmation controls for that engagement.

• You must be at least 18 and use Pursut for business purposes.
• Keep your account information accurate and your password secure. You're responsible for activity under your account.
• Tell us right away at hello@pursut.com if you think your account has been accessed without permission.

Prices are listed on our pricing page at the time you buy. Blueprint and Partnered Launch are one-time fees. Growth is billed monthly and renews each month until you cancel. You can cancel Growth at any time, and cancellation takes effect at the end of the current billing period.

Fees don't include taxes, which you're responsible for where they apply. Refunds and cancellations follow our Refund and Cancellation Policy.

• Give us accurate information and timely access, answers and approvals. Delays on your side can move timelines.
• Only share materials, data and contact lists you have the right to share with us.
• Use our services lawfully, and not to send spam, deceive people or infringe anyone's rights.

Outreach sent under your name

You approve the messaging and targeting for outreach we send on your behalf, and you're the sender of those messages. You agree that your offer and your use of our outreach services comply with applicable laws, including anti-spam laws such as CAN-SPAM. We include opt-out options in campaigns and honor opt-out requests.

We work hard to get your product traction, but markets decide how they respond. We don't guarantee any specific outcome, such as revenue, signups, replies, meetings or rankings. What we commit to is doing the work described in your plan and being open with you about what's working and what isn't.

We use software, including AI models, to help analyze information and draft recommendations and content. A person at Pursut reviews recommendations before they reach you. Final business decisions, and what gets published or sent under your name, are yours to approve.

Your content. You keep ownership of everything you give us. You grant us permission to use it only to provide our services to you.

Deliverables. Once you've paid for them in full, you own the deliverables we create specifically for you, such as your strategy documents, copy and outreach sequences.

Our materials. We keep ownership of our pre-existing and general materials, including our methods, frameworks, templates, software and know-how. Where any of these are part of a deliverable, you get a permanent license to use them as part of that deliverable for your business.

We won't name you as a client or publish your results without your permission.

Each of us will keep the other's non-public business information confidential, use it only for our work together, and protect it with reasonable care. This doesn't apply to information that is public, was already known, is received lawfully from someone else, or must be disclosed by law.

Some work relies on third party services, such as email providers, CRMs, analytics tools and data providers. Your use of those services may be subject to their own terms, and we aren't responsible for their availability or conduct.

Except as expressly stated in these terms, our website, portal and services are provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.

To the extent the law allows, neither of us is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to these terms or our services is limited to the fees you paid us in the 12 months before the claim arose.

You agree to defend and indemnify Pursut against third party claims arising from content or data you provide, outreach you approve, or your breach of these terms.

You can stop using our services at any time. We may suspend or end your access if you breach these terms or use our services unlawfully. When our work ends, you keep the deliverables you've paid for, and the sections of these terms that should naturally continue (such as ownership, confidentiality and limitation of liability) stay in effect.

These terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in California, and both of us consent to their jurisdiction.

We may update these terms from time to time. When we do, we'll change the date at the top, and if the changes are significant we'll tell you by email or in the client portal. Changes don't apply retroactively to work already under way unless you agree.
